YAESU Warranty and Technical Service Terms and Conditions

Preamble
CSY & SON S.p.A., Official YAESU Service Centre, provides authorised technical service for YAESU products in accordance with these terms and conditions.
This page summarises:
- the rights that may apply under the legal guarantee of conformity;
- the YAESU commercial warranty, governed by the official YAESU terms;
- the additional CSY & SON commercial warranty;
- the procedures for requesting service, receiving, inspecting, repairing and returning products;
- warranty exclusions and chargeable services.
The commercial warranties are in addition to any rights provided by applicable law and do not limit them. The legal guarantee of conformity applies to sales contracts between a consumer and a seller in accordance with the applicable legislation.
1. Customer categories
1.1 End customer
An end customer is a person who purchases the product for their own use and not for resale.
Where the end customer qualifies as a consumer under the applicable legislation, the rights arising from the legal guarantee of conformity against the seller shall apply.
Where the end customer purchases for professional purposes or in the course of their business, only the commercial warranties expressly provided and the contractual conditions of the sales relationship shall apply.
1.2 Reseller / B2B Dealer
A reseller or B2B dealer is a professional entity authorised to purchase products from CSY & SON S.p.A. for resale.
The legal guarantee of conformity provided for consumers does not apply to relationships with resellers and B2B dealers; any commercial warranties expressly recognised and the applicable contractual conditions remain in force.
2. Legal guarantee of conformity
The legal guarantee of conformity applies exclusively as provided by law to goods sold to consumers and has a duration of 2 years from delivery of the goods.
The consumer has the right, as a primary remedy, to have the conformity of the goods restored by means of repair or replacement free of charge. In the cases provided by law, the consumer may also obtain a price reduction or termination of the contract. The action is time-barred, as a general rule, within a maximum of 26 months from delivery, within the limits provided by the applicable legislation. For defects that become apparent within 1 year of delivery, the legal presumption of pre-existence of the defect applies, unless proven otherwise.
For the end consumer customer, the party responsible for the legal guarantee is the seller from whom the product was purchased. CSY & SON S.p.A. acts as an authorised service centre and may carry out the technical intervention, without replacing the consumer's rights against the seller.
3. YAESU commercial warranty
The YAESU commercial warranty is governed exclusively by the official terms prepared by YAESU MUSEN.
For the conditions, duration, limitations, procedures and operational details of the YAESU commercial warranty, the official YAESU document is the sole reference. In the attached PDF, YAESU states, among other things, a standard duration of 3 years unless otherwise provided for specific products, validity in the original country/region of purchase, non-transferability beyond the original end-use purchaser or gift recipient, the exclusion of shipping costs to the service centre and the free return of the repaired or replaced product.

4. Additional CSY & SON commercial warranty up to 5 years
CSY & SON S.p.A. offers a free additional commercial warranty of 2 years, extending the commercial coverage to a total of 5 years, exclusively under the conditions set out below.
4.1 Covered products
The additional CSY & SON commercial warranty applies exclusively to YAESU amateur radio transceivers:
- imported by CSY & SON S.p.A.;
- distributed by CSY & SON S.p.A.;
- purchased from CSY & SON S.p.A. or from an authorised reseller who purchased the product from CSY & SON S.p.A.
4.2 Beneficiaries
The 2-year additional CSY & SON commercial warranty:
- is reserved exclusively for the end consumer customer;
- is registered in the purchaser's name;
- is reserved for the first purchaser;
- is non-transferable.
This extension does not apply to end customers who purchased the product for professional purposes or in the course of their business, nor to resellers or B2B dealers.
4.3 Activation requirement
To benefit from the extension from the 4th to the 5th year, the first consumer purchaser must register the product within 30 days of the purchase date through the official procedure indicated by CSY & SON.
Failure to register within 30 days results in non-activation of the 2-year commercial extension.
4.4 Excluded products
The following are excluded from the additional CSY & SON commercial warranty:
- accessories, batteries, microphones, power supplies, antennas, optional modules and any product other than amateur radio transceivers;
- used, demo, ex-display or dealer-used products;
- products purchased outside CSY & SON official channels;
- parallel or unofficial import products;
- products lacking the above provenance requirements.
5. Service request and shipping authorisation
Every service request must be made exclusively through the official CSY & SON service portal.
Submitting a request through the portal does not authorise the customer to ship the product immediately.
After receiving the request, CSY & SON carries out a preliminary check of the documentary eligibility and the information provided. If clarifications or additional information are needed, the customer will be contacted.
Only following approval of the request by CSY & SON will the customer receive an email communication with authorisation to ship the product to the service centre.
Products shipped without prior authorisation, without having correctly completed the procedure through the portal, or without prior consent from CSY & SON will not be considered as properly received. In such cases, CSY & SON reserves the right to apply a nominal administrative fee for handling products received outside the procedure.
6. Required documentation
To open a case, the customer must complete the online procedure in full and provide the required documentation, including, where applicable:
- proof of purchase;
- product identification data;
- serial number;
- detailed description of the defect;
- any photographic or video documentation;
- sender details and contact information;
- proof of registration, if required for the CSY & SON commercial extension.
CSY & SON reserves the right to request additional documentation where necessary.
7. Product receipt and intake
Upon receipt of the authorised product, CSY & SON carries out preliminary administrative, logistical and technical checks, including:
- apparent integrity of the package and product;
- correspondence between the received product and the open case;
- presence and legibility of the serial number;
- correctness and completeness of the documentation submitted.
Once the acceptance phase is complete, the product is entered into the internal workflow and assigned to the laboratory schedule.
8. Technical checks, repair and quality control
Every repair intervention includes an internal quality control carried out by the laboratory at the end of the technical work. This control is intended for the internal verification of the correct functioning of the product after the intervention and does not automatically entail the release of a technical or instrumental report to the customer.
CSY & SON may carry out the repair using new parts or equivalent parts suitable for restoring the product's functionality. Where deemed appropriate, the product may be replaced by the entity managing the relevant commercial warranty.
In the event of product replacement under the commercial warranty, any replacement product benefits exclusively from the remaining warranty period of the original product. The same principle is also provided in the official YAESU terms.
9. Exclusions from the commercial warranty
The following are excluded from the YAESU commercial warranty and the additional CSY & SON commercial warranty, by way of example and without limitation, defects or damage resulting from:
- improper, negligent, abnormal or non-compliant use contrary to the manufacturer's instructions;
- incorrect installation or use with unsuitable accessories, power supplies, cabling, antennas or equipment;
- tampering, opening, repairs, modifications or unauthorised interventions;
- impacts, falls, accidents, crushing, infiltrations, contaminations, oxidation or accidental damage;
- exposure to excessive humidity, liquids, weather conditions, lightning, electrical discharges, overvoltage, incorrect power supply or other anomalies of the electrical system;
- inadequate packaging, improper transport, shipping not in accordance with instructions, or loss/damage occurring during transport to the service centre;
- normal wear and tear, cosmetic deterioration, consumables or components subject to natural degradation;
- alteration, deletion, loss or damage to memories, settings, data or programming;
- modifications to the product to enable its use in countries, bands, standards or configurations other than those for which the product was designed, approved or placed on the market;
- use not in accordance with the purposes for which the product was designed or authorised;
- damage to the RF/PA stage or related components caused by incorrect use, including, by way of example, use with a mismatched antenna or line, excessive SWR, absence of correct load, improper use of power or operating conditions incompatible with the product specifications.
The above exclusions apply to the commercial warranties and do not prejudice any mandatory rights of the consumer under the applicable law.
10. Forfeiture of the commercial warranty
The commercial warranty is forfeited in the event of:
- removal of the serial number;
- illegible serial number;
- altered, counterfeit or tampered serial number.
This approach is also consistent with the official YAESU terms.
11. Products sent as "under warranty" but found to be out of warranty
If a product is sent as a warranty intervention and, following the technical checks carried out by CSY & SON, is found to be out of warranty or not covered by the warranty invoked, CSY & SON will always contact the customer to inform them before proceeding further.
In such cases, any intervention will be handled as an out-of-warranty repair under the conditions set out in Section 13.
12. Shipping costs
12.1 End consumer customer
For interventions handled under the commercial warranty, unless otherwise communicated in writing, the customer bears the costs and risks of shipping the product to the service centre, while CSY & SON bears the costs of return shipping of the repaired or replaced product.
For the legal guarantee of conformity, the consumer's rights against the seller remain in force, including the provision of remedies free of charge under the applicable legislation.
12.2 Professional end customer
For end customers purchasing for professional purposes or in the course of their business, unless otherwise agreed in writing, the customer bears the shipping costs to the service centre. Return shipping of the product repaired under the commercial warranty is borne by CSY & SON, unless otherwise agreed in writing.
12.3 Reseller / B2B Dealer
For resellers and B2B dealers, the shipping costs of the product to the service centre are not covered and remain entirely at the sender's expense. Unless otherwise agreed in writing, CSY & SON bears the return shipping of the product repaired under a recognised commercial warranty intervention.
13. Out-of-warranty interventions and chargeable services
13.1 Out-of-warranty interventions
If the product is out of warranty or the defect found is not covered by the warranty, CSY & SON will proceed as follows:
- if the cost of the intervention exceeds Euro 200.00 + VAT, a quotation will be issued and the intervention will remain on hold pending customer approval;
- if the cost of the intervention is equal to or less than Euro 200.00 + VAT, the intervention is deemed authorised.
13.2 Products sent by resellers with no identifiable defect
In the case of products sent by resellers or B2B dealers for which, following CSY & SON's checks, no technical defect is found or it emerges that the report is solely due to incorrect configuration, wrong settings or failure to consult the user documentation, CSY & SON reserves the right to apply a one-off out-of-warranty handling fee of Euro 30.00 per product.
13.3 Certified Instrumental Testing Service
At the customer's request, a Certified Instrumental Testing Service is available, distinct from the normal internal quality control of the repair.
The service includes in-depth reception and transmission tests, with the issue of a report or technical certification containing, where applicable, the main measured performance values.
The cost of the service is Euro 60.00 + VAT, in addition to any shipping costs.
14. Processing times
The times for intake, diagnosis, repair and return may vary depending on the laboratory workload, the complexity of the defect, the need for further technical checks and the availability of spare parts.
If the necessary spare parts are not available in stock, completion times may extend by several weeks, depending on the manufacturer's availability, procurement times, factory processing and international shipping times.
15. Limitation of liability
To the extent permitted by applicable law, the liability of YAESU and/or CSY & SON under the respective commercial warranties is limited to repair, replacement or, where provided, the value of the product under the conditions of the applicable warranty.
In any event, to the extent permitted by law, indirect or consequential damages, lost profits, business interruption, loss of opportunity, loss or alteration of data, configurations, memories, programming or settings, as well as costs of restoring software, data or configurations, are excluded, save in cases of wilful misconduct or where otherwise required by mandatory law.
16. Products purchased outside official channels
Products purchased outside the official European channels of the brand, as well as products subject to parallel or unofficial import, are excluded from the commercial warranties set out on this page.
Any mandatory rights provided by applicable law against the seller of the goods are preserved, if and to the extent that the relevant requirements are met.
